TERMS AND CONDITIONS (RETAIL)
By using our website https://oemaudio.co.nz/ (or any replacement website) or by purchasing any Goods from us (whether in store or via our website), you are agreeing to these Terms and Conditions. Please read them carefully.


1.    Interpretation
1.1    In these Terms:
(a)    "Business Days” means any day of the week which we are open for business and trading, either in store or via our website.
(b)    “CGA” means the Consumer Guarantees Act 1993.
(c)    “Goods” means the products that are supplied by us to you.
1.2    References to “we, our or us” means OEM Audio Limited and references to “you or your” means you as the customer.
1.3    A reference to any legislation includes that legislation as amended or substituted and includes any regulations made under that legislation.
2.    Price and Payment
2.1    All prices of Goods are in New Zealand dollars and are inclusive of GST and other sale taxes. We may charge a credit card payment fee or paywave fee in addition to the price.
2.2    All in store payments may be made by cash, Eftpos or credit card. Payments through our website must be made by credit card. All payments made through our website are processed via the secure Payment Express Gateway which secures your credit card information
2.3    Any prices that are displayed as $0.00 are due to a system error. While we take every effort to ensure accurate pricing, any prices for Goods which are due to a system error will not be honoured.
2.4    If there is a difference between the price initially shown on our website and the price shown in the shopping cart area of our website, we may charge the price which is the actual price of the Goods.
3.    Delivery
3.1    Delivery of the Goods will be made to you at the address provided in your order. The delivery address must be an address within New Zealand and can be a PO Box, Private Bag or a freight forwarding location.
3.2    On receipt of your order, we will dispatch the Goods to your specified delivery address within five (5) Business Days of the date you place your order. 
3.3    We use the services of New Zealand Post to complete delivery. Each package will have a tracking number. The time of delivery will be subject to the availability of their network. For example, deliveries to the Chatham Island may take longer or may not be available at certain times.
3.4    If any Goods arrive damaged, please contact us within 24 hours of delivery. We will arrange to have the damaged Goods returned to us and we will either repair or replace the Goods or refund the purchase price to you. This will be our decision but we will discuss the matter with you first. 
3.5    If the Goods arrive damaged, you must return them to us in the same condition that you received them in with all original packaging, together with all packing slips.
4.    Installation 
4.1    We may offer general installation advice however we accept no responsibility for that advice. 
4.2    Where Goods need to be installed in a vehicle, installation needs to be completed by a professional car audio electrician with automotive electrical knowledge and knowledge of modern car audio head units featuring the latest technology. If the Goods are installed by someone else, then the manufacturer’s warranty may become invalid. If this occurs, you may still have rights under the CGA.
4.3    Installation of wall chargers must be completed by a registered electrician. If this does not happen, then the manufacturer’s warranty may become invalid. You may however still have rights under the CGA. 
4.4    All instructions and installation methods relating to Goods must be followed and any warnings relating to Goods must be observed. If these instructions are not followed, then the manufacturer’s warranty may become invalid. If this occurs, you may still have rights under the CGA.
5.    Guarantees and Warranties
5.1    Our Goods come with our warranty and a manufacturer’s warranty. You may also have additional rights under the CGA.
5.2    If you consider that the Goods do not comply with a warranty or the CGA then you must notify us as soon as possible and provide evidence of the issue.   
5.3    We will not be liable for Goods which have been tampered with or modified without our approval or which have not been stored or used in a proper manner.
6.    Refunds
6.1    Unless the CGA applies, we have no obligation to provide you with a refund for Goods you have purchased. If we do decide to provide a refund, then we will do so within seven (7) Business Days of notifying you of our decision.
7.    Fitting Kits
7.1    Some of our fitting kits are not available for purchase without purchasing the matching head unit.  Any online order of such a fitting kit will not be dispatched. We will contact you within two (2) Business Days of the date your order is placed to arrange a refund of payment of the price and any shipping costs.
8.    Limitation of Liability
8.1    Unless the CGA applies, we will not be liable for:
(a)    failure of the Goods as a result of installation by an unqualified electrician or substandard installation;
(b)    deterioration of the Goods due to exposure to the elements after delivery or installation; or
(c)    any loss you incur due to you purchasing the Goods.
9.    General
9.1    If you have received the Goods through a third party promotional programme, the Goods are not transferrable, refundable or redeemable.
10.    Review of Terms
10.1    We may change these Terms from time to time. Any change to these Terms will take effect from the date the new terms are included on our website. 
11.    Intellectual Property
11.1    We own all intellectual property and copyright on our Website and it may not be used without our permission.
